Hyderabad,April 29: The AP High Court on Wednesday passed an interim order suspending a memo issued by the government directing the ACB not to initiate preliminary or regular enquiry or to register cases against all-India service officers and heads of department without prior permission from the Chief Minister.
A division bench comprising Chief Justice Anil R. Dave and Justice Ramesh Ranganathan passed the interim order on Wednesday.
The court was dealing with a petition filed by Mr C Narayana of Penaka-cherla village in Ananta-pur district, challenging the memo issued by the government in 1996.
According to the memo, the director-general of ACB will send confidential reports of all-India service officers including IAS, IPS and IFS and also heads of departments to the chief secretary and obtain orders from the Chief Minister to proceed against them in case of allegations of corruption against them.
Mr P.V. Krishnaiah, counsel for the petitioner, told the court that because of such protection, all-India service officers may adopt corrupt practices without any fear.
On April 24, the AP High Court had suspended a government memo that stopped the ACB from arresting staff caught in disproportionate assets cases.

Oil and gas exploration in the Krishna Godavari basin will not harm the environment

Hyderabad, April 28 : Oil and gas exploration in the KrishnaGodavari basin will not harm the environment or disturb the ecological balance in the region, the Centre informed the AP High Court.
Mr Kishor Kumar Darad, environment head in the Directorate-General of Hydrocarbons, argued in his counter that the anticipated sinking of land due to exploration in the Krishna-Godavari basin was neither directly nor remotely related to the extraction of oil resources from the basin.
He told the court that there was no evidence of such an instance anywhere in the world. The HC had earlier issued a notice to the Centre to file its counter on a petition submitted by the Krishna Godavari Deltala Parirakshana Samiti seeking a direction to take appropriate steps to protect the region from land subsidence and environmental hazards due to exploration.
Mr Darad said in his counter: “Extraction of ground water on a massive scale is mainly responsible for sinking of land the world over.”
Mr A. Rajasekhar Reddy, the assistant solicitor-general, said that so far there was no case of major land subsidence in the country due to exploration of oil and natural gas.
Mr Darad told the court that the Central Mining Research Institute and a team from the civil engineering department of IIT Mumbai conducted a detailed investigation in the basin on alleged subsidence due to exploration.

AP High Court not to give info on court order

Hyderabad, April 25 : The AndhraPradesh High Court refused to pass an order on a petition filed by one Mr K. Gandaiah, seeking information on why the former principal and district sessions judge of Ranga Reddy district has passed an erroneous order without taking into consideration the merits of the case.
Mr Gandaiah, a resident of Puppalguda in Rajendranagar mandal, filed the petition alleging that the judge ignored the written arguments and memos filed by the petitioner while passing an order in his case.
The petitioner told the court that he sought to know the reasons under the Right to Information Act but his application was rejected by the authorities.
Mr Bojja Tarakam, senior counsel, appearing for the petitioner argued that their main contention was to know why the judge had allegedly committed errors in passing the order and why he omitted to examine patently fabricated documents submitted by the respondents in the case.
A division bench comprising Chief Justice Anil R. Dave and Justice R.Subhash Reddy while refusing to pass an order on the petition disposed of the writ and suggested the petitioner to prefer an appeal on the order of the lower court.

What is the basis for the so called political analysts to asses winning chances of a political party in Andhra Pradesh. After the first phase of poll three main contenders in AP, i.e. Congress, Mahakutami lead by Telugu Desam and new comer in political arena Praja Rajaym claimed more than 100 seats. The first phase was conducted to elect 154 candidates out 294 seats in the State Assembly.
Many of the analysts acknowledged in support of either of the claimants. A political party or a group of allied parties have an every right to claim their victory in the elections and the Constitution provided the right. But it’s my surprise that the analysts who appeared on TV screens acknowledged the claims either way.
A question is boggling in my mind what is the criteria and what is the mechanism they have to asses or to analyse or to predict the victory of a party ?

Migrants in Praja Rajyam may bleak winning chances of TD
Hyderabad, April 25 : Migrants from Telugu Desam Party to Praja Rajyam may have bleak winning chances of TD candidates in more than 30 Assembly constituencies in the state in the election. The Praja Rajyam allotted seats to all most all the leaders including erstwhile second –in-commond of TD Mr T Devender Goud.
According to the political analysts these leaders will cut the vote bank of the TD and there is every chance of losing of these seats by TD. In one or two seats the PRP provided seats to migrants from Congress Party.

AP High Court allows ACB to arrest staff

Hyderabad, April 24: The AP High Court on Friday suspended a government memo stopping the ACB from arresting staff caught in disproportionate assets cases.
The memo had been issued on October 10, 2008. The ACB said it had arrested just two staff after the memo came into force. The government contended it had issued the memo at the employees’ request.
A division bench comprising Chief Justice Anil R. Dave and Justice R. Ranganathan was hearing a petition filed by Prof. M.S. Rama Krishna, a freedom fighter, asking the memo be overturned.

No revival of Begumpet airport

Hyderabad, April 17: The Central government on Friday told the Andhra Pradesh High Court that it was not possible to revive or expand flight operations at the Begumpet airport.
The additional solicitor-general of India, Mr Gopala Subramaniam, while arguing before a division bench comprising Justice B. Prakash Rao and Justice R. Kantha Rao, submitted that the decision to close down the Begumpet airport fell within the realm of a policy decision and was outside the scope of judicial review.
The bench was dealing with a petition filed by a journalist, Mr S. Srinivas Reddy, from Saroornagar against the closure of the Begumpet airport.
The petitioner contended that there was no specific provision in the Aircraft Act 1934 and the Airports Authority of India Act, 1994, for the closure of existing airport.
Mr Subramaniam refuted the petitioner’s contentions and said that the decision of the closure was backed by the provisions of the Act and also a policy decision of the Centre.
He told the court that the Centre also issued notification for the closure of Delhi and Bengaluru airports after the new airports came into operation.He submitted that the process of commissioning of a new airport at Shamshabad had started almost a decade ago and the process was finalised in 2004.
This included the provision to close the airport at Begumpet. The court reserved its orders.

RAS -Al-Khaimah govt guarantee to Hyderabad Economic City project approved

Hyderabad, April 12 : The state government informed the Andhra Pradesh High Court that the proposed Hyderabad Economic City project was given the guarantee of the government of RAS-Al-Khaimah through its nominated agency, the RAK Investment Authority (RAKIA).
Mr B. Sam Bob, principal secretary of industries and commerce department, had submitted an affidavit to the court stating that there was no law that prohibits the government to enter into an agreement with other governments and companies to serve the interests of the people.
The High Court had earlier issued a notice to the government seeking its version on a petition filed against the allotment of lands to the project. Mr Bob, in his reply, said that the project is envisaged with a huge investment and when projects of such magnitude are taken up, there was heavy competition among many state governments which try to attract investments by giving various concessions.
He said that there was no risk factor involved in the agreement and the government has taken all measures to protect and preserve its lands. He told the court that Tamil Nadu, Karnataka, Kerala and Gujarat had also started joint venture with RAS-Al-Khaimah.
He contended that the discretion conferred on the government to take the decision was not misused.
While refuting the contentions of the petitioner, Mr Bob said that no land was either conveyed or transferred or even contemplated to be transferred in favour of RAKIA. He submitted to the court that lands are to be assigned to the joint venture company as per the terms of collaboration agreement.
The lands which were assigned to the JVC was treated as equity investment of the state government in the project. He urged the court to dismiss the petition as there was no public interest involved in it.

Probe into girl students harassment

Hyderabad,April 7: A division bench comprising the Chief Justice, Anil R. Dave, and Justice Ramesh Ranganathan of the AP High Court on Tuesday directed the West Godavari SP to conduct aninquiry into allegations that two Zilla Parishad High School teachers misbehaved with girl students.
The court was dealing with a petition filed by Mr G. Srinivasa Rao, an employee of Mahatma Gandhi Yoga Vidyalayam at Bhimavaram.
According to the petitioner, four girl students of the school at Veeravasaram village were allegedly sexually harassed by two teac-hers in December 2008.
The issue came to light when the victims lodged a complaint with the principal. Mr Ramalinga Swamy, counsel for the petitioner, said the students protested against the alleged misconduct of the teachers and sought action against them on December 11, 2008.
He complained that the district administration did not initiate any action against the erring teachers except transferring them.The bench, while expressing concern, asked the counsels of the home department, Ms Rachana, and the school education department, Mr P. Srinivasulu, whether they would have kept quiet if it happened to their own child?
Justice Ramesh Ranganathan said according to law, the police is empowered to act on any information they receive. The court passed an order directing the SP to probe into it.

CBI court takes up Telgi plea

Hyderabad, April 3 : A CBI special court has started hearing discharge petitions of multi crore fake stamps case accused Abdul Kareem Telgi and others.
At present, the case is at the stage of framing charges and the accused have approached the court seeking discharge saying that the CBI failed in proving charges against them.
It is mandatory to frame charges against the accused before commencing the final trial in the case.
Most of the accused in the scam are police officers.
The Andhra Pradesh High Court has already quashed criminal proceedings against three police officers including Narasimha Rao IPS, Satyanarayana Reddy ACP and Ashfaq Ahmed Khan, an inspector.
Abdul Wahed Quadri alias Raees Quadri, an aide of Telgi, was also discharged following a directive of the High Court.
The latest petition has been filed by Telgi, Vijayender Reddy, former inspector of Begumbazar and Madhu Mohan, sub inspector of City Central Crime Station.
The Special Judge, Mr V.Raghunath Rao, has commenced the hearing on discharge petitions.
Mr C. Mallesh Rao, counsel for Madhu Mohan, pointed out that the investigators did not recover any material to prove his involvement in the crime.
He submitted the court that the only charge against Madhu Mohan was that he ‘de-froze’ the bank account of the stamp scam accused on the illegal instructions of the deputy police commissioner of the city central crime station.

Hyderabad, April 2: The Praja Rajyam on Thursday released its sixth list ofcandidates for the ensuing polls for three Lok Sabha and 27 Assembly seats.Mr Chiranjeevi will contest from Palakollu Assembly seat along with Tirupati. TTD board chairman D.K. Adikesavulu Naidu's son Mr D.A.Srinivas will contest from Rajampet Lok Sabha. Noted film writer, MrPosani Krishna Murali, also got a berth.
